Rihanna Wins Lawsuit Over Topshop Tees Featuring Her Face
At first, it was reported that Ri would pocket a cool $5 million from the suit she brought against the company, but now it's said that the amount of damages are undetermined. Regardless, for Topshop, it's a big, fat and expensive OOPS!
E! reports that High Court Judge Justice Birss said that a"substantial number" of consumers nabbed the tee because they likely believed that Rihanna herself endorsed it. And she didn't.
The photo was an issue since it was similar to images taken while RiRi filmed her 'We Found Love' video in Northern Ireland in 2011. The photos were used in the 'Talk That Talk' packaging. Even though the retailer bought the rights from the photographer, using a similar and unauthorized image was considered deceptive.
The judge felt that the sales damaged the singer's goodwill and created a negative effect on her reputation in fashion.
While famous people do not generally have the right to control how their images are reproduced, this case was different.
"The taking of the photograph is not suggested to have breached Rihanna's privacy," Birss said. "The mere sale by a trader of a T-shirt bearing an image of a famous person is not an act of passing off. However, I find that Topshop's sale of this T-shirt was an act of passing off."
Anyone else besides us find it funny that Rihanna sued over a shirt, when she is famous for taking hers off and posting topless selfies all over Instagram? How ironic!
