Eating and driving.

We've all done it.  You hit the drive-thru at your favorite burger joint and you just can't wait until you get home.  You start working on that combo meal by chowing on a few fries, then all of sudden, you need a bite of that cheeseburger.  No harm right?

So you got your hands on the wheel with a cheeseburger, that may or may not be dripping ketchup and mayo down your hands.  You come to a red light next to a cop, and he or she sees you in all your glory.  Is this illegal?

Could this get you a distracted driving ticket?

The technical answer is?  No.  According to an article on Trusted Choice, there is nothing specific in the distracted driving laws in North Dakota saying you can't eat and drive.  However, if your eating causes you to commit a violation, you could be ticketed for an additional violation for distracted driving.  Let's just say you run a red light, and the cop sees you with a taco in your hand, this could defiantly get you the additional distracted driving charge.

Okay, let's review.

Is eating and driving illegal in North Dakota?  It's okay as long as it doesn't cause you to commit a violation.  Otherwise, you could be looking at two violations.  The exception would be if you decide to drive with your knees while you eat a bowl of chili.  I would not recommend this for a variety of reasons, but this would almost certainly get you pulled over without committing another violation.

Got it?  Good.  Now don't eat and drive if you can help it.  It makes your car stinky.
