A suspect was shot Tuesday afternoon, after removing a Bismarck officer's gun during a struggle.

[UPDATE 2/19]: The suspect has been identified as Paul Fitzgerald Smith II. He has been charged with felony disarming of law enforcement officer, simple assault on a peace officer, and possession of stolen property.

According to KFYR-TV, shortly after 5pm, a Bismarck officer was making a traffic stop at 16th St. and Thayer Ave. The suspect exited his vehicle and became combative with the officer.

During the struggle, the suspect managed to remove the officer's gun from its holster. When the officer had realized this, he attempted to take the gun back, which led to the firearm discharging and striking the suspect in the thigh.

The officer took the suspect into custody and called an ambulance. The suspect was taken to a local hospital for treatment.

Neither the suspect nor the officer have been identified at this time.
